Public Defender
New York State Law requires
that all defendants who face the possibility of being sentenced to any amount
of time in jail be provided an attorney if they are financially unable to
obtain one.
In Yates County, the Public Defenders Office handles these cases.
In the event that the Public Defenders Office cannot take assignment due to a
conflict of interest, the defendant's case is referred to the Yates County
Assigned Counsel program for assignment of an attorney.
These services are
free to all defendants who meet financial eligibility. The Judge will ask
about your ability to obtain an attorney and your finances to determine if you
qualify for assignment of counsel. You will be provided with a Public Defender
application at the time of your arraignment if you request a Public Defender.
